APPLICATION

All services rendered by or on behalf of Luxury Travel Life (Pty) Ltd (“Luxury Travel Life”) to the client are subject to the terms and conditions (“the Conditions”) set out below.

By engaging with our services, the client confirms that they have read, understood, and agreed to be bound by these terms and conditions.


COMPANY DETAILS

Luxury Travel Life is a South African-based luxury travel agency specializing in bespoke travel experiences, curated itineraries, and high-end travel solutions across the globe.These Terms and Conditions must be read and understood prior to confirming any travel arrangements. Proceeding with a booking confirms that you acknowledge and accept all provisions contained herein.


SCOPE OF SERVICES

Luxury Travel Life offers a combination of concierge travel planning and access to a curated online platform, enabling clients to:

View and compare travel and accommodation options;

Set personalized criteria for trips based on unique preferences;

Request custom quotations and tailored experiences;

Confirm and reserve luxury travel services including accommodation, tours, transport, and more.

Please note: unless specifically stated, advisory or consultancy services are available upon request and are not automatically included with online bookings.


CLIENT RESPONSIBILITY AND AUTHORITY

Any individual utilizing the services provided by Luxury Travel Life is deemed to have full authority to do so on behalf of all travelers in the booking. By submitting personal and payment details, the client confirms full understanding and acceptance of these terms and conditions.

Unless explicitly requested at the time of booking, Luxury Travel Life reserves the right to engage with any traveler listed under the booking reference number. Changes made by any such traveler are considered binding and will not be the responsibility of Luxury Travel Life.


THIRD-PARTY SERVICE PROVIDERS

Luxury Travel Life partners with leading service providers within the global travel and hospitality industries, including but not limited to: luxury hotels, private resorts, cruise lines, tour operators, and transportation services (“Service Providers”).

When booking with us, you acknowledge that:

Luxury Travel Life acts solely as an intermediary and booking agent for these third-party providers.

The contractual relationship exists directly between the client and the respective Service Provider.

Luxury Travel Life shall not be liable for any loss, delay, injury, damage, or inconvenience caused by any act or omission of a Service Provider, except where due to our own gross negligence or willful misconduct.

The terms and conditions of each Service Provider will apply in addition to those outlined here, and clients are strongly encouraged to review such terms before confirming their travel.


Custom Travel Packages

For travel experiences tailored exclusively for a client, Luxury Travel Life cannot warrant the refund ability or amenability of bookings once confirmed. Clients are responsible for reviewing all related supplier terms and conditions associated with their custom itinerary.


PROMOTIONAL OFFERS

From time to time, Luxury Travel Life may promote exclusive offers in partnership with luxury travel brands. These promotions are subject to special eligibility requirements and specific terms, which will be communicated at the time of the offer.

Booking Specifics and Additional Charges

Please note:

Full fare conditions may not always be displayed at the time of online booking. We encourage clients to contact a Luxury Travel Consultant for clarification.

Airlines and other service providers may charge additional fees for seat selection, meal preferences, boarding pass printing, or checked luggage. These fees are subject to change and are the client’s responsibility.

Travel insurance is strongly recommended and may be required for certain itineraries or destinations.


BOOKING ENQUIRIES AND RESERVATIONS

Upon initiating a travel enquiry—either through our website, over email, phone, or through direct contact with our consultants—you will receive a personalized quotation ("Quote") reflecting the current total cost of the proposed itinerary.

Acceptance of the Quote occurs when you proceed with the next steps to finalize your booking online or confirm via email or phone. Full payment of the quoted amount ("Payment") is required to secure the reservation with the relevant service providers ("the Booking"). Once the reservation is complete and payment is authorized, we will issue a Booking Confirmation with full itinerary details.

Please note: for services such as airline tickets, payment must be received and reflect in our account by midnight (South African time) on the same day the booking is made to guarantee the quoted fare. Air tickets carry specific fare conditions, many of which are partially or fully non-refundable. If you have questions about these terms before booking, please consult one of our Travel Designers.


DESTINATION SELECTION

Clients acknowledge that all destination selections and itineraries are made based on online or consultant-shared information. While we strive for accuracy and quality in our recommendations, final arrangements are coordinated by external service providers and may vary. Luxury Travel Life cannot be held liable for differences between advertised offerings and actual experiences delivered by third parties.

Additionally, seating and availability at hotels, airlines, or events are subject to real-time confirmation by the provider. We do not guarantee availability until your booking has been confirmed.


PAYMENTS AND PAYMENT TERMS

Payment must be made promptly upon acceptance of a quote and may be made via:

Credit cards (Visa, MasterCard, American Express)

Electronic Funds Transfer (EFT)

Bank cash deposit

All transactions are processed in South African Rand (ZAR). International clients may incur currency conversion or international transaction fees, which are the sole responsibility of the client. Luxury Travel Life does not offer payment credit facilities, unless pre-arranged in writing.

Failure to complete payment within the specified timeframe may result in the automatic cancellation of the booking. If a new quote is issued due to delay, you will be liable for any difference in cost should you choose to proceed.


PRICING, EXCHANGE RATES, AND QUOTES

Quotes are calculated using prevailing exchange rates and are subject to change until full payment is received. If the exchange rate changes before confirmation, we reserve the right to adjust your quote accordingly. Clients are advised to verify current pricing at the time of payment.

In group bookings, deviations in the number of participants may require recalculation or surcharges, as determined by the relevant service provider. Refusal to accept such changes may result in cancellation and forfeiture of payments or fees.


SERVICE FEES AND AMENDMENT CHARGES

Luxury Travel Life applies a non-refundable service fee to all bookings, which reflects the time and care invested in curating and securing premium travel experiences. Amendment or cancellation of bookings may incur additional service and supplier fees, which will be disclosed prior to finalizing any changes.


TRAVEL DOCUMENTS AND BOOKING CONFIRMATION

Travel documents, itineraries, and confirmations will only be released once full payment has been received. Parents traveling with minors must comply with South African immigration laws, including the provision of unabridged birth certificates and consent affidavits where applicable.

Name Accuracy

Clients must ensure that names on bookings exactly match passport or ID documents. Any discrepancies may result in denied boarding or additional fees for ticket reissuance. Certain providers do not allow name changes at all. Luxury Travel Life is not responsible for any consequences arising from incorrect personal information.

Passports, Visas, and Health Requirements

It is entirely the client's responsibility to ensure they have valid passports, visas, required vaccinations, and comply with travel health protocols. This includes ensuring sufficient passport validity (typically 6 months post-return) and blank pages for visa stamps.

Transit visas may also be required, depending on your route and passport. Please consult the relevant consulate or embassy before booking. While our team may assist where possible, any support provided is at our discretion and does not constitute liability or guarantee outcomes.

Medical Precautions and Disease Warnings

If your itinerary includes regions with a risk of tropical diseases such as malaria or yellow fever, you are strongly advised to consult your healthcare provider and take necessary preventative measures. Luxury Travel Life accepts no liability for illness resulting from travel in such areas.


TRAVEL INSURANCE

We strongly recommend comprehensive travel insurance to cover cancellations, medical emergencies, baggage loss, and other unforeseen events. If requested, our team can refer you to trusted insurance providers. However, we are not responsible for coverage levels or claims disputes, and clients are encouraged to review their policies carefully, especially when relying on credit card travel insurance, which may offer limited protection.


CANCELLATIONS AND REFUNDS

If you cancel your trip, we reserve the right to retain part or all of your payment in accordance with both our policy and the terms of each supplier involved. Cancellations due to death or hospitalization of the traveler may be exempt from penalties upon submission of supporting documents.

Refunds are processed in accordance with the service provider’s policy, and a processing fee may apply. Some tickets and packages are strictly non-refundable. If you miss any leg of your journey, unused segments may be forfeited by the airline or provider without compensation.


UNSCHEDULED CHANGES OR DISRUPTIONS

Should there be schedule changes, cancellations, weather-related delays, or force majeure events, any extra costs (e.g. meals, accommodation, or transfers) will be at your expense. We advise confirming your flights and travel plans at least 72 and 24 hours before departure.

While we will do our best to inform you of any changes communicated to us by the service providers, Luxury Travel Life is not liable for delays in the relay of such information due to provider or operational constraints.


INDEMNITY AND LIMITATION OF LIABILITY

Luxury Travel Life, its staff, and representatives shall not be liable for any losses, delays, damages, injuries, illnesses, trauma, or inconveniences arising from your travel arrangements, except in the case of our proven gross negligence. Our liability, where applicable, is limited to R10,000 per client per booking.

Clients acknowledge the inherent risks of travel and agree to indemnify Luxury Travel Life from all claims outside the scope of our control.


ITINERARY VARIATIONS AND TRANSFERS

Every effort is made to adhere to your confirmed itinerary. However, Luxury Travel Life and its travel partners reserve the right to make reasonable changes where necessary, such as in cases of weather disruptions or supplier availability. These changes are made in the interest of guest safety, enjoyment, or logistical necessity and do not qualify for a refund. It is the client’s responsibility to review and confirm any changes to the itinerary. For return flight bookings, failure to use the outbound portion may result in cancellation of the entire ticket unless pre-arranged with the airline.


PROMOTIONAL OFFERS

Discounted and promotional packages are valid for limited periods and are non-refundable, non-transferable, and non-changeable, unless otherwise stipulated at the time of booking. Deposits are only accepted on bespoke or offline bookings where agreed in writing.


CAR RENTALS

Drivers must present a valid South African or international driver's license and a credit card in their own name when collecting the vehicle. If the credit card used for the booking is different, providers may request additional verification. Terms and conditions vary by rental company—clients are expected to review and agree to the specific rental company's policies prior to confirmation.


LEGAL JURISDICTION

These terms are governed by the laws of the Republic of South Africa, and any legal disputes shall fall under the jurisdiction of the South African courts. Luxury Travel Life may, at its discretion, institute legal proceedings in any competent court of law, regardless of monetary jurisdiction.


SPECIAL REQUESTS

If you have dietary needs, medical conditions, accessibility requirements, or other special requests, please notify us in writing at least 48 hours prior to departure. While we will do our best to accommodate you, fulfillment of such requests cannot be guaranteed.


REFUNDS AND TRIP CANCELLATION

Unless you have purchased a Trip Cancellation and Refund Protection Plan at the time of booking, no refunds will be considered under any circumstances by Luxury Travel Life. Supplier refunds will follow their own policies and timeframes. We will assist in facilitating refunds where applicable, but processing may take 4–12 weeks or longer, depending on the provider.

Cancellation penalties apply to all refundable tickets, and some are completely non-refundable. Delays, force majeure, or personal emergencies do not automatically qualify you for reimbursement. Travel insurance is highly recommended.


FOREIGN EXCHANGE COMPLIANCE

Clients are solely responsible for ensuring compliance with South African Reserve Bank and exchange control regulations when paying for international bookings.


E-TICKETS AND REQUIRED DOCUMENTS

You must travel with a valid passport or ID, visa (if applicable), and the credit card used for booking. For minors, unabridged birth certificates and parental affidavits are mandatory. It is your responsibility to ensure all required travel documentation is complete and accurate prior to departure.


ONLINE BOOKINGS AND AUTHORIZATION

By instructing us to make bookings online, you authorize Luxury Travel Life to make selections, provide quotations, and complete payments on your behalf. You will always receive a confirmation before the booking is finalized.


LIMITATION OF LIABILITY

Luxury Travel Life, its directors, staff, and agents accept no liability for loss, injury, or damage unless caused by gross negligence or willful misconduct. All claims must be submitted in writing within 30 days of your travel date and are subject to a maximum compensation limit of R10,000 per person. We do not accept liability for indirect, punitive, or consequential damages.


LEGAL COSTS

In any legal dispute where Luxury Travel Life prevails, the client will be liable for legal costs on an attorney-client scale.


CONFIDENTIALITY

All client information is treated as strictly confidential, subject to any lawful or court-ordered disclosure requirements.


TRAVEL RECONFIRMATION

Clients are responsible for reconfirming all travel arrangements at least 72 hours before departure and again 24 hours prior to flight times. Flight schedules may change without prior notice.


SOCIAL MEDIA CODE OF CONDUCT

We expect respectful engagement on all our social platforms. Discrimination, harassment, or offensive conduct of any kind will not be tolerated. We reserve the right to remove content and take legal action against violators.


FEEDBACK

If you experience any dissatisfaction with your travel arrangements, please contact us at info@luxurytravellife.com within 96 hours of returning so we can investigate and resolve the issue. Claims regarding baggage loss or airline mishandling must be reported directly to the airline before exiting the airport.


WEBSITE & ONLINE BOOKINGS

All online bookings made via our website are governed by these terms and the specific Online Booking Terms in place at the time of transaction


LIABILITY DISCLAIMER

Information, visuals, and descriptions of services featured on the Luxury Travel Life website or platforms ("the Sites") are provided by third-party service providers and may contain inaccuracies or errors. While we strive for accuracy, we do not guarantee the completeness, accuracy, or reliability of content including hotel amenities, destination information, images, or ratings.

Hotel ratings and property listings are offered as general guidelines. Any reliance on such content is at your own discretion.

All information is provided “as is” without warranties of any kind. We make no endorsements or representations regarding the suitability, reliability, or accuracy of services displayed or offered.

Luxury Travel Life is not liable for inaccuracies, service disruptions, overbookings, cancellations, force majeure events, government restrictions, or any resulting expenses or damages. Travel decisions remain the responsibility of the client, including ensuring awareness of relevant advisories or travel bans.

In no event shall Luxury Travel Life or its affiliates be liable for any indirect, incidental, or consequential damages, including delays, lost profits, or damages arising from use or inability to access the Sites, even if previously advised of potential damages.



RISK ACKNOWLEDGMENT FOR DESTINATIONS

By purchasing travel to specific destinations, you acknowledge that certain regions may pose higher risks due to political instability, weather, or health concerns. Luxury Travel Life does not warrant that travel to any location is risk-free and assumes no liability for losses or disruptions related to such risks.



INDEMNITY

The client agrees to defend and indemnify Luxury Travel Life, including its directors, staff, and affiliates, against any claim, legal demand, penalty, or cost arising from:

A breach of these Terms;

A violation of any law or third-party rights;

Misuse of the Sites or services.


LAWFUL USE

Clients agree to use our Sites and services only for lawful purposes. You will not use the Sites in any manner prohibited by South African law or these Terms.


THIRD-PARTY WEBSITE LINKS

The Sites may contain links to external websites. Luxury Travel Life is not responsible for the content, accuracy, quality, or services offered on any third-party site. Inclusion of such links does not imply endorsement. Clients access such sites at their own risk and agree to indemnify Luxury Travel Life from any resulting claims.


APPLICABLE LAW

These Terms are governed by the laws of the Republic of South Africa. Jurisdiction is granted to South African courts, regardless of where bookings are made.


GENERAL LEGAL TERMS

Use of the Sites in jurisdictions where these terms are unenforceable is not authorized. No partnership, agency, or employment relationship arises from use of the Sites.

Should any provision of these Terms be deemed invalid, the remaining provisions remain in effect.

This document, along with any referenced terms or policies, constitutes the entire agreement between Luxury Travel Life and the client regarding use of the Sites.


COMMUNICATIONS POLICY

By booking with us, you consent to receive transactional and promotional communications. You may unsubscribe from promotional communications at any time, though booking-related notifications will continue for the duration of your reservation lifecycle.


POPIA AND DATA PRIVACY POLICY

Luxury Travel Life is committed to safeguarding your personal data in accordance with the Protection of Personal Information Act, 4 of 2013 (POPIA).

By engaging our services, you agree that we may:

Collect and process personal information as needed to fulfill travel bookings;

Share information only with employees or third parties who require it for service delivery;

Store and back up data securely, using appropriate measures in line with POPIA.

You further acknowledge that you have read and agree to our Privacy Policy, and understand the purpose and scope of how your information will be used.


BUS OPERATOR TERMS

For bookings involving intercity bus services, clients are bound by the terms of the respective operators. These include, but are not limited to:

No-show tickets are non-refundable, and all changes or cancellations must be handled directly with the bus operator.


ENTIRE AGREEMENT

These Terms constitute the entire agreement between the client and Luxury Travel Life. No verbal or written communication outside these Terms shall have binding effect unless formally acknowledged in writing by both parties.
